Dodik to propose ban on BiH Const Court and SIPA actions in RS

Republika Srpska (RS) entity National Assembly session, where the Law on the Non-Application of the Decisions of the Constitutional Court of Bosnia and Herzegovina is being discussed, the entity President said that he will be the one to propose the suspension of the Court and the Prosecutor's Office of Bosnia and Herzegovina, as well as the prohibition of work of the State Investigation and Protection Agency (SIPA) in the RS, due to the alleged lack of constitutional basis for their work.

“I will be the one who will propose to the Assembly the adoption of those laws, to prohibit the operation of SIPA if it takes any measures, to prohibit the operation of the Prosecutor's Office in the territory of the RS, to not apply the decisions of the Court of Bosnia and Herzegovina until they acquire a constitutional basis for this,” he announced, noting that this will follow if those institutions do not allow a political agreement on the current issue.

“This is the day when we start a completely new story, it implies that we’ll have our relationship with the Constitutional Court in this way, as we had the other day with that fake High Representative. Nowhere in Dayton was it written that the decisions of the High Representative would be published in the RS Official Gazette, nor was it foreseen that he would make decisions that would publish them,” Dodik said, noting that since 2010 or 2011, not a single decision of the High Representative had been published in the RS.

“We are not violating the Dayton Agreement this time, we are setting a limit, let's pass the Law on the Constitutional Court of Bosnia and Herzegovina,” he said, noting that the proposal is for three judges to be elected by the RS, and six by the Federation of Bosnia and Herzegovina (FBiH) entity.

“If the Constitutional Court makes a decision, possibly one, and says the court in Trebinje or the court in Istocno Sarajevo will return it for a new procedure, the moment a judge returns it, we will immediately come to the National Assembly and abolish that court, so it will be left without budget funds,” the RS President said, noting that there will be changes to the RS Criminal Code, which will prescribe prison sentences of at least one year “for anyone who violates this law.”
