RS Constitutional Court rules Bosnian lilies illegal under entity law

The Constitutional Court of Republika Srpska entity ruled today in Banja Luka that amendments to the entity's Criminal Code banning the display of the flag of the former Republic of Bosnia and Herzegovina, do not violate the vital national interest of the Bosniak constituent people.

The ruling was delivered by the Council for the Protection of Vital Interest during a session held on August 19, addressing a challenge brought by the Bosniak Caucus in the Council of Peoples. The caucus had argued that the legislation aimed to penalise the display of official symbols of the Republic of Bosnia and Herzegovina within the territory of Republika Srpska.

In its statement, the Council concluded that the arguments presented by the Bosniak Caucus were irrelevant. The Court stated that the disputed law does not address the flag of the Republic of Bosnia and Herzegovina nor touch upon the international legal continuity of Bosnia and Herzegovina.

Furthermore, the Council found no direct connection between the symbols of the former armed formation and the constitutional safeguards concerning education, religion, language, tradition, or cultural heritage.

The amendments to the Criminal Code were originally passed by the National Assembly of Republika Srpska on July 9, introducing prohibitions regarding symbols associated with the Independent State of Croatia and the Army of the Republic of Bosnia and Herzegovina.

Following the parliamentary vote, Ramiz Salkic, a member of the Vakat movement, voiced strong opposition to the legislative changes, arguing that they marginalized the Bosniak population and restricted their ability to express empathy and tradition. Salkic stated at the time that the provisions would be contested before the state-level constitutional court, noting that expectations from the entity-level court remained low.
