EU spokesperson: High Rep's powers should be used “only as a measure of last resort”

Executive powers of the High Representative in Bosnia and Herzegovina (Bonn powers) should be used only as a measure of last resort against irreparable unlawful acts, the EU said commenting on the envoy's announcement of possible imposing of changes to the electoral legislation.

“The EU takes note of High Representative Schmidt’s [announcement of 19 December to amend the Election Law of Bosnia and Herzegovina. The EU recalls that the executive powers of the High Representative (Bonn Powers) should be used only as a measure of last resort against irreparable unlawful acts,” EU spokesperson Peter Stano told N1.

As key priority identified in the Opinion on BiH’s membership application from 2019, he noted, “the EU expects Bosnia and Herzegovina to ensure that elections are conducted in line with European standards by implementing OSCE/ODIHR and relevant Venice Commission recommendations, and ensure transparency of political party financing.”

Stano also recalled of the the European Council's decision that called on Bosnia and Herzegovina to urgently finalise constitutional and electoral reforms.

“Domestic institutions, including the Parliament, must be given the time and chance to take responsibility and adopt reforms, as they committed to do,” he said. 

High Representative Christian Schmidt announced on December 19 he would impose the Election Law changes if the political elites fail to do that in the upcoming period.
