The Council of Peoples in the Constitutional Court of Bosnia’s Republika Srpska (RS) entity decided that a recent RS law, according to which the new genocide denial ban in the country will not be implemented, does not violate the national interest of Bosniaks in the entity.
The RS National Assembly adopted the law in question soon after the former High Representative who oversees the civilian implementation of the Dayton Peace Agreement imposed a law making genocide and war crimes denial as well as glorification of convicted war criminals, a punishable offence.
On July 30, RS lawmakers passed a law on the non-implementation of the genocide denial ban on the territory of the RS.
This prompted Bosniak MPs in the entity parliament to asked the RS Constitutional Court to review whether the new law violated the Bosniak vital national interest.
The Court’s Council of Peoples determined that the new RS law “does not have a national dimension” and applies equally to all RS citizens, regardless of their ethnic background.
It also said that it does not directly or indirectly affect any of the three constituent peoples in the RS.
